FMC Terms & Conditions — version 1.4. These Terms & Conditions are between you (the model, creator or talent applying to FMC) and Fashion Models Collective (“FMC”, “we”, “us”). By ticking “I agree to the Terms & Conditions” on the application form you accept them. They include our content & marketing licence, confirm you are 18 or over, and incorporate our Privacy Policy (how we use your data).
In plain English
- You keep ownership of your content and your image. You are not signing it away.
- You give FMC and the brands you work with through FMC permission to use the content you make for a campaign to market and distribute that campaign.
- You get paid a fixed fee for each campaign — agreed up front and released once your work is delivered and approved, whether or not the campaign drives sales. The licence is part of that deal; there is no hidden extra grant.
- It is non-exclusive: you can still post your work elsewhere and work with whomever you like.
- FMC sends you The Collective, our bulletin (about one issue a month), by email and as an app notification. You can switch either one off at any time in your account settings.
1. Agreement & eligibility
By ticking “I agree to the Terms & Conditions” on the application form, you agree to these Terms, to the content & marketing licence in clause 3, and to our Privacy Policy (which is incorporated into these Terms). You confirm you are 18 years of age or older. These Terms also work alongside any specific campaign deal you accept through the FMC platform.
2. Who keeps ownership
You keep ownership of the content you create and of your name, image, voice and likeness. Nothing here transfers ownership to FMC or to a brand. What you give is a licence — permission to use that content for the purposes below — not a sale.
3. The content & marketing licence
3.1 You grant FMC and the brand partner(s) you are matched with through FMC a non-exclusive, worldwide, royalty-bearing licence (paid through your campaign earnings) to use, reproduce, edit for length/format, publish, display and distribute the content you create for an FMC campaign (the “Content”), including your name, image, likeness and handle as they appear in that Content.
3.2 This licence is for marketing, advertising and distribution of the relevant campaign and the products it features, across: (a) the brand’s social media and paid advertising; (b) FMC’s own channels and marketing; and (c) the brand’s and FMC’s websites and marketplaces.
3.3 Duration: the licence lasts for the campaign’s usage term set out in the campaign deal. If no term is stated, it lasts twelve (12) months from the date the Content is first posted, after which paid distribution stops unless you agree to extend.
3.4 FMC and the brand may make minor edits (cropping, trimming, captions, format changes) but must not edit the Content in a way that materially misrepresents you or is defamatory.
3.5 Uses beyond clause 3.2 — for example out-of-home, print, TV, or use after the term — require your separate agreement and may earn you additional fees.
4. How you get paid
You are paid a fixed fee for each campaign you are booked on, agreed up front in that campaign deal. Your fee is not contingent on sales: once you have delivered the agreed work and it is approved, your fee is released to you through the FMC platform, regardless of how the campaign performs. The brand pays for the booking through Stripe, and your fee is released to you once your deliverables are approved or the review period ends. FMC does not offer an escrow, trust or client-money account; the booking status in the app shows where a payment stands. Amounts shown to you are net of the FMC platform fee. The licence in clause 3 is granted in consideration of those campaign earnings; there is no separate licence fee unless agreed in writing.
5. Your promises
- You are 18 or over.
- The Content is your original work, or you have all rights needed to grant the licence in clause 3 (including rights to any music, locations, products or other people featured).
- The Content does not infringe anyone else’s rights and is not unlawful, misleading, defamatory or offensive.
- You will include any advertising disclosures required by law or by the platform you post on (for example #ad / “paid partnership”).
- The information you give FMC (including your profile, audience figures and identity) is true and accurate.
6. What FMC and brands will not do
We will not use your Content in a way that is defamatory, that materially misrepresents you, or that falsely implies you endorse something you did not agree to promote. We will not sell your personal data for cash; data is handled under the FMC Privacy Policy.
7. Non-exclusive & your freedom
This is non-exclusive. You keep the right to use your own Content and to work with other brands, agencies and platforms, except where a specific campaign deal sets a short, clearly-stated exclusivity window for that campaign.
8. Taking content down & ending these Terms
You can stop applying to new campaigns at any time. Licences already granted for live campaigns continue for their stated term so paid placements are not pulled mid-flight. If you have a genuine concern about a specific piece of live Content (for example a privacy or safety issue), contact FMC and we will deal with reasonable takedown requests in good faith and as required by law. We may suspend or remove your account if you breach these Terms or the community rules, or for safety, fraud or legal reasons.
9. Data & privacy
How FMC collects and uses your personal data is explained in the FMC Privacy Policy, which forms part of these Terms & Conditions. By agreeing to these Terms you acknowledge the Privacy Policy.
10. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited. Otherwise, FMC is not liable for indirect or consequential loss, and FMC’s total liability to you in any 12-month period is limited to the campaign earnings paid or payable to you through FMC in that period.
11. General
We may update these Terms; if we make a material change we will tell you and, where needed, ask you to re-accept. These Terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction. Contact: rsvp@fashionmodelscollective.com.
12. Acceptable use, community rules, reports and removal
12.1 Acceptable use. You must not post, send or upload anything that is unlawful, abusive, harassing, threatening, hateful, sexually explicit, violent or misleading, or that infringes anyone’s rights or shares another person’s private information. You must not impersonate another person or business, or send spam. FMC has no tolerance for objectionable content or abusive behaviour. This applies everywhere you can add content or contact others through FMC, including messages, FMC Connect chats, Gallery photos and videos, timeline posts, reviews and your profile. These are the community rules referred to in clause 8.
12.2 Reporting and blocking. You can report any message, photo, video, post, review or member from the app (and use the “Report a problem or content” form in Settings), and you can block other members.
12.3 What we do about reports. FMC staff review every report and will act on it within 24 hours. We may remove content, hide it, warn a member, pause a member’s use of a feature, suspend an account or end a membership, with or without notice where the breach is serious or repeated.
12.4 Our right to remove. FMC may remove or refuse any content, and suspend or eject any user, that breaks these Terms or the community rules, or that we reasonably believe puts others at risk. We do not promise to read every message or look at every item before it is posted.
12.5 Age. FMC is for people aged 18 or over. You must be at least 18 to apply for or keep a membership.
12.6 Contact. To report something urgent, or to ask about a decision, write to rsvp@fashionmodelscollective.com.
13. The Collective (our bulletin)
13.1 What it is. The Collective is FMC’s bulletin, published as a new issue about once a month. By joining FMC and agreeing to these Terms, you agree that we send you each new issue of The Collective by email and as a notification in the FMC app.
13.2 Your choice. You can switch the email and the app notification off, each on its own, at any time under Settings in your account, on the website and in the app. Every email also has an unsubscribe link that stops the emails at once.
